The procurement law is no longer a matter of Member States, especially with a view to the basics of EU law. Cross-border awards increase. The international competition is gaining momentum. In order to enforce its rights effectively in the European area, the Council adopted the (Legal) Remedy Coordination Directive 89/665/EEC and the Sector Remedies Coordination Directive 92/13/EEC. It follows from the legal nature, however, that the legal protection and the redress mechanisms are not the same in each Member State.

Sehr geehrte Damen und Herren,

das Vergaberecht ist im Hinblick auf die insbesondere europarechtlichen Grundlagen keine nur mitgliedstaatliche Angelegenheit mehr. Grenzüberschreitende Vergaben nehmen zu. Der internationale Wettbewerb nimmt an Fahrt auf. Um im europäischen Rechtsraum seine Rechte effektiv durchsetzen zu können, hat der Rat für das Vergaberecht die Rechtsmittelkoordinierungsrichtlinie 89/665/EWG sowie die Sektorenrechtsmittelkoordinierungsrichtlinie 92/13/EWG erlassen. Aus der Rechtsnatur der Richtlinie folgt allerdings, dass nicht in jedem Mitgliedstaat die Rechtsschutzmöglichkeiten und das Rechtsschutzverfahren identisch aufgebaut sind. Vielmehr steht den Mitgliedstaaten ein Spielraum zur Umsetzung der Richtlinienvorgaben zur Verfügung.
